Welcome to ThriftyNifty. By accessing or using the ThriftyNifty mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to create an account and use the Service. By registering, you represent that the information you provide is accurate and that you will maintain only one personal account.

2. Account Responsibilities

• You are responsible for maintaining the security of your account and password.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate information and keep it up to date.
• You may not transfer or share your account with another person.

3. Following Stores & Communications

When you follow a store on ThriftyNifty, you opt in to receive promotional emails and announcements from that store. These may include information about new items, sales, events, and other store news.

• You can unfollow a store at any time from the store's page to stop receiving communications from that store.
• You can also adjust your email notification preferences per store (e.g., turn off new item alerts while keeping promotions).
• Unfollowing a store immediately stops all future promotional emails from that store.
• Transactional emails (reservation confirmations, responses to your requests) are not affected by follow status and will be sent as long as you have an active account.

4. Acceptable Use

You agree to use the Service in a lawful and respectful manner. Specifically, you agree not to:

• Post fake, misleading, or fraudulent item requests or listings
• Use deceptive photos, descriptions, or pricing
• Harass, threaten, or abuse other users, store staff, or ThriftyNifty team members
• Spam stores with excessive or irrelevant requests
• Scrape, crawl, or programmatically access the Service without written permission
• Impersonate another person, store, or entity
• Use the Service for purposes unrelated to buying, selling, or donating secondhand goods
• Attempt to circumvent account suspensions or bans by creating new accounts

5. Reputation System

ThriftyNifty maintains a reputation system for shoppers to promote reliability and trust.

• You earn points by successfully picking up reserved items.
• You lose points for no-shows (failing to pick up a confirmed reservation).
• Your reputation score recovers gradually over time.
• If your reputation score drops to -3 or below, your ability to make reservations will be temporarily suspended until your score recovers.
• Stores cannot see your exact score. The system operates automatically and without bias.

6. Reservations

• Reservations are not binding purchase agreements. They indicate your intent to visit the store and purchase the item.
• Stores may confirm or decline reservation requests at their discretion.
• Once a reservation is confirmed, you have 3 days to pick up the item unless otherwise specified by the store.
• Failure to pick up confirmed reservations may result in a no-show, which will negatively affect your reputation score.
• All payments are made directly to the store at the time of pickup. ThriftyNifty does not process payments between shoppers and stores.

7. Rewards, Points & Coupons

• Rewards points, coupons, and promotional offers are provided by participating stores, not by ThriftyNifty.
• ThriftyNifty serves as the technology platform that facilitates rewards tracking and coupon delivery on behalf of stores.
• Point values, earning rates, redemption policies, and coupon terms are determined solely by each participating store or store group.
• Stores may modify, suspend, or discontinue their rewards program at any time at their discretion.
• ThriftyNifty is not responsible for the fulfillment, value, or availability of any rewards, points, or coupons offered by stores.
• For questions about a specific store's rewards policy, please contact the store directly.

8. Store Responsibilities

If you register a store on ThriftyNifty, you additionally agree to:

• Provide accurate business information, store hours, and listing details
• Honor confirmed reservations in good faith
• Use the subscriber messaging feature only for relevant store communications (promotions, events, new arrivals) — not spam or unrelated content
• Accurately report pickup completions and no-shows
• Comply with all applicable local, state, and federal laws regarding the sale of secondhand goods

9. Content You Provide

You retain ownership of any content (photos, descriptions, text) you submit to the Service. By submitting content, you grant ThriftyNifty a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content in connection with operating the Service.

You represent that you have the right to submit any content you provide and that it does not infringe on any third party's rights.

10. Termination & Suspension

ThriftyNifty reserves the right to suspend or permanently ban any account that violates these Terms, engages in abusive behavior, or disrupts the Service. This includes but is not limited to:

• Repeated no-shows or abuse of the reservation system
• Posting fraudulent or misleading content
• Harassment of other users or store staff
• Creating multiple accounts to circumvent a suspension

We may take these actions without prior notice. If you believe your account was suspended in error, you may contact us at the email below.

11. Limitation of Liability

ThriftyNifty is a marketplace platform that connects shoppers with thrift stores. We do not own, operate, or control any store listed on the Service. Accordingly:

• We are not responsible for the quality, condition, accuracy, or availability of any items listed by stores.
• We are not responsible for the conduct of any store, store employee, or shopper.
• We are not liable for any loss, damage, or injury arising from your use of the Service or any transaction with a store.
• The Service is provided "as is" without warranties of any kind, express or implied.

12. Changes to These Terms

We may update these Terms at any time without prior notice. Changes take effect immediately upon posting. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.
